1. Agreement to Terms

By accessing or using the You Bid We Haul website, mobile application, or services (collectively, the “Service”), operated by You Bid We Haul (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

You Bid We Haul provides auction item pickup and delivery services in the Las Vegas, Nevada metropolitan area. We pick up items won at Nellis Auction locations and deliver them to customers within our service area. Our Service is available exclusively through our iOS mobile application.

3. Eligibility

You must be at least 18 years old and reside within our service area (Las Vegas, Henderson, North Las Vegas, and Summerlin, NV) to use our Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

To use the Service, you must create an account and provide accurate, current, and complete information including a valid delivery address, payment method, and Nellis Auction account access. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. Pricing and Payment

Our current pricing is a flat rate of $5.00 per item for items under 10 lbs. Your first delivery is $0.01 as a promotional offer for new customers. Payment is processed via Stripe and charged upon pickup of your item(s) from Nellis Auction. By providing a payment method, you authorize us to charge the applicable fees for each delivery order.

6. Delivery Terms

  • Delivery is guaranteed within 5 business days of item pickup from Nellis Auction.
  • Delivery is curbside/doorstep only. We do not provide in-home placement or white-glove service at this time.
  • Proof of delivery is provided via photograph of the item at your delivery location.
  • Our service area covers the core Las Vegas metropolitan area (approximately 15-mile radius).

7. Item Limitations and Damage

We currently accept items under 10 lbs only. If an item is damaged or missing at the time of Nellis Auction pickup, our driver will document the condition with photographs and notify you. The item will be delivered as-is, and any disputes regarding item condition must be handled directly with Nellis Auction. We are not liable for pre-existing damage or missing items.

8. SMS/Text Messaging Terms

By providing your mobile phone number and opting in to receive text messages from You Bid We Haul, you consent to receive recurring SMS/MMS messages from You Bid We Haul regarding your orders and our service, including but not limited to:

  • Order confirmation notifications
  • Driver assignment updates
  • Pickup status from Nellis Auction
  • Out-for-delivery alerts
  • Delivery confirmation with photo proof
  • Launch updates and service announcements
  • Account and service-related communications

How to opt in: You may opt in to receive SMS messages from You Bid We Haul through any of the following methods:

  • Text keyword: Text HAUL to (855) 908-5218 from your mobile device. This keyword is advertised on our website at youbidwehaul.com, on flyers and business cards distributed at Nellis Auction pickup locations, and in our marketing materials. By texting the keyword, you are providing your express consent to receive recurring SMS/MMS messages from You Bid We Haul.
  • In-app consent: During account creation or order placement in our iOS mobile application, you may opt in by checking the SMS consent checkbox (unchecked by default).

Message frequency: Message frequency varies based on your order activity and service updates. You may receive up to 10 messages per order, plus occasional launch and service announcements.

Message and data rates may apply. Your carrier may charge standard messaging rates. We are not responsible for any charges from your mobile carrier.

Opt-out: You may opt out of SMS messages at any time by replying STOP to any message sent to or from (855) 908-5218. You may also text STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. After opting out, you will receive one final confirmation message. Opting out of SMS does not cancel your orders or account.

Help: For help with SMS messaging, reply HELP to any message or contact us at hello@youbidwehaul.com.

Consent is not a condition of purchase. You are not required to opt in to SMS messaging in order to use our Service or make a purchase.

No mobile information sharing. We will not sell, rent, or share your mobile phone number or any information collected through our SMS program with third parties or affiliates for marketing or promotional purposes.

Supported carriers: Our SMS program is supported by all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

9. Nellis Auction Account Access

To schedule pickups on your behalf, you grant us limited access to your Nellis Auction account for the sole purpose of scheduling pickup appointments and entering our driver as an authorized pickup person. We will not use your Nellis Auction account for any other purpose.

10. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by You Bid We Haul and are protected by copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

To the fullest extent permitted by law, You Bid We Haul shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific delivery giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless You Bid We Haul, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may cancel your account at any time by contacting us at hello@youbidwehaul.com.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Clark County, Nevada.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page with a new “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
